Corte Interamericana realiza convocatoria abierta para presentar observaciones en nueva Solicitud de Opinión Consultiva

San José, Costa Rica, 7 de junio de 2019. – A partir de hoy y hasta el 10 de septiembre de 2019 la Corte Interamericana de Derechos Humanos (“Corte” o “Tribunal”) recibirá observaciones sobre la solicitud de Opinión Consultiva presentada por Colombia.

El objeto de la solicitud de Opinión Consultiva es obtener una interpretación por parte de la Corte sobre tres aspectos en general:

  1. El alcance de las obligaciones internacionales que en materia de protección y promoción de los derechos humanos tiene un Estado miembro de la OEA que ha denunciado la Convención Americana;
  2. Los efectos que sobre dichas obligaciones tiene el hecho de que dicho Estado, más adelante, tome la medida extrema de denunciar del instrumento constitutivo de la Organización regional y busque retirarse efectivamente de la misma; y
  3. Los mecanismos de que disponen, de un lado la comunidad internacional y, en particular, los Estados miembros de la OEA, para exigir el cumplimiento de dichas obligaciones y hacerlas efectivas, y del otro los individuos sujetos a la jurisdicción del Estado denunciante, para exigir la protección de sus derechos humanos, cuando se presenta un cuadro de violaciones graves y sistemáticas de los mismos.

En tal virtud, el Tribunal convoca a Estados, universidades, Academia, organizaciones no gubernamentales, asociaciones profesionales, personas individuales, órganos estatales, organizaciones internacionales, y, en general toda aquella persona interesada en presentar observaciones. El plazo límite para presentación de observaciones escritas vence el 10 de septiembre de 2019.

El escrito deberá observar los siguientes requisitos:

  1. Indicar el nombre de la institución o personas que lo suscriben y datos que permitan la identificación del remitente.
  2. En cualquier caso, tanto si es presentado por una persona como por un grupo de personas, se deberá acompañar copia del documento de identidad de cada una de ellas.
  3. Si una organización es la que presenta el escrito, éste deberá estar firmado al menos por su representante legal y deberá remitirse los documentos pertinentes que demuestren tal representación y la existencia legal de la organización.
  4. Contener la dirección, correo electrónico y números de teléfono donde se tendrán por recibidas oficialmente todas las comunicaciones y notificaciones que el Tribunal envíe.
  5. Indicar si se tiene la intención o no de participar en una eventual audiencia pública sobre la Opinión Consultiva.

Inter-American Court of Human Rights makes an open call to submit
observations in new Request for an Advisory Opinion

San José, Costa Rica, 7 de junio de 2019. – As of today and until September 10, 2019, the Inter-American Court of Human Rights (“Court” or “Tribunal”) will receive observations on the request for an Advisory Opinion presented by Colombia.

The purpose of the request for an Advisory Opinion is to obtain an interpretation by the Court on three aspects in general:

  1. The scope of international obligations that a State member of the OAS that has denounced the American Convention has regarding the protection and promotion of human rights;
  2. The effects on these obligations derived from the fact that the State, further on, takes the extreme measure to denounce the constitutive instrument of the regional Organization and seeks to effectively withdraw from it; and
  3. The mechanisms at the disposal, on the one hand, of the international community and, in particular, the member states of the OAS, to demand compliance with these obligations and make them effective, and on the other of the individuals subject to the jurisdiction of the denouncing State to demand the protection of their human rights, when there is a pattern of serious and systematic violations of them.

In view of the above, the Tribunal calls upon States, universities, Academia, non-governmental organizations, professional associations, individuals, State bodies, international organizations, and, in general, any person interested in submitting observations. The deadline for submitting written observations expires on September 10, 2019.

The writing must observe the following requirements:

  1. Indicate the name of the institution or persons that subscribe it and the information allowing the identification of the sender.
  2. In any case, whether it is presented by a person or by a group of people, a copy of the identity document of each of them must be attached.
  3. If the written observations are presented by an organization, it must be signed by at least its legal representative and the pertinent documents proving such representation and the legal existence of the organization must be attached.
  4. Contain the address, email and telephone numbers where all communications and notices that the Tribunal sends will be officially received.
  5. Indicate whether or not there is an intention to participate in a possible public hearing on the Advisory Opinion.
