CIDH CULMINA VISITA DE TRABAJO A ARGENTINA

Washington, D.C., 3 de mayo de 2010 – La Comisión Interamericana de Derechos Humanos (CIDH) realizó una visita de trabajo a Argentina del 25 al 27 de abril de 2011. La delegación de la CIDH estuvo encabezada por la Comisionada Luz Patricia Mejía Guerrero, en su calidad de Relatora para Argentina. La visita tuvo por objetivo impulsar el cumplimiento de acuerdos de solución amistosa y de recomendaciones de la CIDH, para lo cual la delegación se reunió con altas autoridades de los Poderes Públicos Nacionales y Provinciales, así como con representantes de organizaciones de la sociedad civil.

En esta oportunidad, la Relatora Mejía Guerrero enfocó su visita en la promoción de la eficacia de las decisiones de los órganos del sistema interamericano de protección de derechos humanos, en particular, en la importancia del cumplimiento de las recomendaciones emitidas por CIDH. En ese sentido, la Relatora expresó su reconocimiento al Estado argentino por la reciente incorporación del delito de desaparición forzada de personas al Código Penal, en seguimiento de las recomendaciones emitidas por la CIDH en el caso Iván Torres. La Comisión Interamericana valora positivamente este avance normativo, con base en la obligación de respetar los derechos consagrados en la Constitución Nacional, en la Convención Americana sobre Derechos Humanos y en la Convención Interamericana sobre Desaparición Forzada de Personas.

Asimismo, la Relatora Mejía Guerrero impulsó el cumplimiento de otras recomendaciones de carácter legislativo, tales como el anteproyecto del nuevo Código de Procedimientos en Materia Penal de la Nación y el de la Ley sobre principios mínimos en materia de doble instancia, y la adecuación del régimen de justicia penal juvenil a los instrumentos internacionales en esa materia.

Durante su visita la Relatora Mejía Guerrero se reunió con el Vice-Ministro de Relaciones Exteriores, Comercio Internacional y Culto; el Ministro de Justicia, Seguridad y Derechos Humanos; el Procurador General de la Nación; la Procuradora del Tesoro; y el Presidente de la Corte Suprema de Justicia de la Nación. Asimismo, sostuvo una reunión con las Comisiones de Derechos Humanos, de Derecho Penal y de Familia de la Cámara de Diputados. En el orden provincial, y en el marco de casos individuales, la delegación sostuvo reuniones con autoridades de las Provincias del Chaco, Mendoza, Salta y Santa Fe.

La Comisión agradece la cooperación brindada por el Gobierno de Argentina, en particular a la Cancillería, para la realización de esta visita.

Adicionalmente, el 28 de abril de 20011, la Relatora Mejía Guerrero participó en la Reunión de Alto Nivel sobre la Agenda de los Derechos Humanos en el Siglo XXI organizada por el Centro Internacional para la Promoción de los Derechos Humanos del Ministerio de Justicia y Derechos Humanos de la Nación. Finalmente, el 29 de abril de 2011, en su calidad de Relatora sobre los Derechos de las Mujeres, la Comisionada Luz Patricia Mejía presentó el informe Acceso a Servicio de Salud Materna desde una Perspectiva de Derechos Humanos, en un acto celebrado en la sede de la Defensoría General de la Nación.

La CIDH es un órgano principal y autónomo de la Organización de los Estados Americanos (OEA), cuyo mandato surge de la Carta de la OEA y de la Convención Americana sobre Derechos Humanos. La Comisión Interamericana tiene el mandato de promover la observancia de los derechos humanos en la región y actúa como órgano consultivo de la OEA en la materia. La CIDH está integrada por siete miembros independientes que son elegidos por la Asamblea General de la OEA a título personal, y no representan sus países de origen o residencia.

IACHR CONCLUDES WORKING VISIT TO ARGENTINA

Washington, D.C., May 3, 2011—The Inter-American Commission on Human Rights (IACHR) carried out a working visit to Argentina on April 25-27, 2011. The IACHR delegation was headed by Commissioner Luz Patricia Mejía Guerrero, in her capacity as Rapporteur for Argentina. The purpose of the visit was to promote compliance with friendly settlement agreements and IACHR recommendations, and the delegation met with high-level national and provincial government authorities, as well as representatives of civil society organizations.

During the visit, Rapporteur Mejía Guerrero focused on promoting the effectiveness of the decisions made by the bodies of the inter-American system for the protection of human rights and, in particular, the importance of complying with recommendations issued by the IACHR. Along these lines, the Rapporteur recognized the State of Argentina for recently incorporating the crime of forced disappearance of persons into its Criminal Code, pursuant to recommendations the IACHR had issued in the Case of Iván Torres. The Inter-American Commission commends this legal advance, which is based on the obligation to respect the rights established in the National Constitution, the American Convention on Human Rights, and the Inter-American Convention on Forced Disappearance of Persons.

Rapporteur Mejía Guerrero also encouraged compliance with other recommendations of a legislative nature, such as the draft legislation for the new National Code of Criminal Procedures and the bill establishing minimum principles on the right to review of a conviction, and the adaptation of the juvenile criminal justice system to international instruments in this area.

During her visit, Rapporteur Mejía Guerrero met with the Deputy Minister of Foreign Affairs, International Trade, and Worship; the Minister of Justice, Security, and Human Rights; the Attorney General of the Nation; the Treasury Attorney General; and the President of the Supreme Court of Justice of the Nation. She also held a meeting with the Chamber of Deputies’ Commissions on Human Rights, on Criminal Law, and on the Family. At a provincial level, in the context of individual cases, the delegation met with authorities of Chaco, Mendoza, Salta, and Santa Fe provinces.

The Commission thanks the government of Argentina, and particularly the Foreign Ministry, for the cooperation it provided for this visit.

In addition, on April 28, 2011, Rapporteur Mejía Guerrero participated in the High-Level Meeting on the Human Rights Agenda of the XXI Century, organized by the Ministry of Justice and Human Rights’ International Center for the Promotion of Human Rights. Finally, on April 29, in her capacity as Rapporteur on the Rights of Women, Commissioner Luz Patricia Mejía presented the report Access to Maternal Health Services from a Human Rights Perspective, during a ceremony held at the headquarters of the Office of the General Ombudsman of the Nation.

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for human rights in the region and acts as a consultative body to the OAS in this matter. The Commission is composed of seven independent members who are elected in a personal capacity by the OAS General Assembly and who do not represent their countries of origin or residence.
