CIDH PRESENTA CASO SOBRE ARGENTINA ANTE LA CORTE IDH

Washington, DC, 22 de diciembre de 2010 – La Comisión Interamericana de Derechos Humanos (CIDH) presentó ante la Corte Interamericana de Derechos Humanos (Corte IDH) el Caso 12.524, Fontevecchia y D’Amico, respecto de Argentina.

El caso trata sobre la violación del derecho a la libertad de expresión de Jorge Fontevecchia y Hector D’Amico, quienes en el momento de los hechos eran director y editor de la Revista Noticias, respectivamente. La CIDH concluyó que la condena civil que les fue impuesta por la publicación de dos artículos en 1995 sobre un hijo no reconocido del Presidente Carlos Menem con una diputada nacional no observó los requerimientos exigidos por la Convención Americana sobre Derechos Humanos para encontrar justificada la imposición de responsabilidades ulteriores por el ejercicio de la libertad de expresión. En consecuencia, la Comisión estableció que el Estado impuso una restricción desproporcionada del derecho a la libertad de pensamiento y de expresión de las víctimas. El caso se envió a la Corte IDH porque la Comisión consideró que el Estado no cumplió con las recomendaciones contenidas en el informe de fondo.

La CIDH es un órgano principal y autónomo de la Organización de los Estados Americanos (OEA), cuyo mandato surge de la Carta de la OEA y de la Convención Americana sobre Derechos Humanos. La Comisión Interamericana tiene el mandato de promover la observancia de los derechos humanos en la región y actúa como órgano consultivo de la OEA en la materia. La CIDH está integrada por siete miembros independientes que son elegidos por la Asamblea General de la OEA a título personal, y no representan sus países de origen o residencia.

IACHR TAKES CASE INVOLVING ARGENTINA TO INTER-AMERICAN COURT

Washington, D.C., December 22, 2010—The Inter-American Commission on Human Rights (IACHR) filed an application with the Inter-American Court of Human Rights in Case 12.524, Fontevecchia and D’Amico, involving Argentina.

The case has to do with the violation of the right to freedom of expression of Jorge Fontevecchia and Hector D’Amico, who at the time of the events in question were director and editor, respectively, of the magazine Noticias. The IACHR concluded that the civil judgment imposed against them over the publication of two 1995 articles about an unacknowledged child of President Carlos Menem and a national congresswoman did not meet the requirements called for by the American Convention on Human Rights to justify the imposition of subsequent liability for the exercise of freedom of expression. Consequently, the Commission established that the State imposed a disproportionate restriction on the victims’ right to freedom of thought and expression. The case was sent to the Inter-American Court because the Commission believed that the State had not complied with the recommendations contained in the report on the merits.

A principal, autonomous body of the Organization of American States (OAS), the IACHR derives its mandate from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission has a mandate to promote respect for human rights in the region and acts as a consultative body to the OAS in this matter. The Commission is composed of seven independent members who are elected in a personal capacity by the OAS General Assembly and who do not represent their countries of origin or residence.
